STORY
This case began a new international effort to report to the United Nations High Commissioner for Human Rights, The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) next autumn to recommend the Japanese judiciary and the media for a law to protect the rights of women, children, and educational facilities. It will be submitted to the UN session. Business and Human Rights and Child’s Rights are considered.
Victorinox AG CEO Carl Elsner of Swiss Army knife, the owner of the international preschool building in Tokyo, Victorinox Japan K.K. President, Yosuke Nishikawa and their lawyers, attacked the preschool for blackmailing during the pandemic and spread Fake News against the Founder of a global women's rights icon by Character Assassination in order to cover up their wrongdoing.
During the pandemic, the Tokyo preschool became the primary target for blackmailing of the Big 4 law firms due to the court shutdown for Covid-19. The preschool received 19 scam cases by lawyers and individuals during the 3 years of the pandemic. The 70% of the scam cases were done by lawyers.
On April 1, 2020, the First Emergency State of Covid-19 was announced in Tokyo. Victorinox AG in Switzerland’s Financial Manager, Michael Tschumperlin contacted the preschool proposing a new contract “to continue the lease relationship” to sign and pay an immediate “additional 10-month rent security deposit”, an illegal % of penalty fees and a female discriminated “male only” guarantor term. The harassment escalated when the preschool politely requested to improve the content.
On May, 2020, their proposal changed to “Rent was Penalty Fees” claim. They claimed “The rent paid in the past years was never the rent, but Penalty Fees Equivalent to Rent Amount” and pay additional “Penalty Fees” of US$2M.
On October 21, 2021, Victorinox sent the law enforcement to the preschool unannounced and evicted the preschool’s charity organization for children with disabilities.
On December 2, 2021, Victorinox sent the law enforcement suddenly showed up at the preschool entrance with no advance notice and broke into the preschool of 100 children of ages 0-6. The court agents warned against filming and threatened to arrest the teachers for "heavy crimes." Teachers were preparing for the next day’s Christmas party, babies were having naptime and toddlers were having kindergarten classes.
Several teachers, nurses, and office staff were pushed to the floor when trying to protect the children, injured and carried to the emergency care for examinations. The victims are still suffering from trauma and PTSD, unable to return to work as of today.
The parents came forward. The diplomatic parents organized the highest security from the Embassy, sent an official diplomatic letter from the Embassy in Tokyo to the Embassy in Bern to be delivered to Carl Elsener demanding for the safety for the children.
Other parents organized an evacuation facility in case of emergency and filed Termination of Eviction Decision Claim to the court because The Metropolitan Police (Azabu) and Tokyo Metropolitan Government Nursery Department (Minatoku) didn’t take any actions.
The preschool and the parents believed the unethical money collection would go away when the pandemic was over.
On December 23, 2021, Carl Elsener sent a response letter to the diplomatic parent stating the preschool’s report was untrue.
The diplomatic parent responded that he knew the preschool building and it was absolutely inconceivable that there could be forced evictions without the children noticing and in the worst case, being traumatized, commenting he was amazed that a company with the reputation of Victorinox decides to have a preschool with children from 6 months of age evicted in the middle of the teaching process.
On December 24, 2021, the preschool office team received a call from tabloid Shukan Bunshun journalist, Tomoko Kanda threatening they would publish a “Yakuza Story” on January 6, 2022, New Year Special Edition. The preschool’s US legal counsel from California issued a legal letter against the tabloid and the journalist and it was cancelled.
In Japan, when the Yakuza come calling, one in five Japanese companies admit to paying them off.
Victorinox continued sending eviction threats when the preschool was paying the rent every month. In order to stop the eviction each time, the preschool must pay Termination of Eviction Claim fees in cash the next day and it gets collected by the building owner. The preschool and the parents paid US$500K cash to maintain the safety.
On March 20, 2023 at 7:30 am, Victorinox’s lawyer, Sachiko Omuro escorted 14 men of law enforcement team and confiscated children's work, academic materials, furniture, funds and everything, leaving children traumatized. Victorinox has been non-responsive.
On the same day, lawyer, Sachiko Omuro posted a false legal statement poster from inside of the preschool building for public viewing. The poster photo went viral on Twitter.
The poster included lawyer Sachiko Omuro’s contact information and collected Negative Group (parents who are mentally unstable, suspended parents and dismissed employees from the past and people who envy the preschool) and processed "Group Brainwashing'' forming a staged news for TV and tabloids.
Global activists, educators, nurses, and parents have united to campaign against Victorinox's actions and created this website and social media.
On May 4, 2023, Victorinox tried to silence the victims of violence by filing a complaint against our campaign website at WIPO, World Intellectual Property Organization in Geneva, Switzerland.
On May 25, 2023, Carl Elsener and Veronika Elsener of Victorinox AG filed a defamation case against the founder, minor and school in Schwyz, Switzerland alleging the campaign website. The claimed ones had nothing to do with the campaign website and it was created by the families of the victims of violence.
On May 30, 2023, TV Asahi broadcasted a headline new on “Good Morning” show alleging that the preschool had not paid rent for five years, leading to the mass eviction. This news, raged by 1.7 million viewers and spawning harmful 6,700 comments on YouTube was picked up by various media outlets within the day.
Forbes Japan issued a public apology for the honoring article on the school which spread to nationwide tabloids with discriminatory languages, cyber bullying and death threats against the Founder for 3 months. All media intentionally avoided fact-checking in order to create a made-up story to rage.
Contrary to these reports, the school consistently paid rent in advance until July 2023 as per Victorinox AG’s instruction. Furthermore, the Founder had relocated overseas and stepped away from local operations in 2019. During the pandemic, the school remained open to support families, only to become a target for traditional Japanese blackmailing by lawyers. The aggressive tactics, including eviction threats, confiscation of assets and cash, further fueled this controversy.
On July 31, 2023, Victorinox AG’s complaint was denied by WIPO confirming there was enough evidence and the website was created in Good Faith. Victorinox's complaint was to silence the victims in order to release and rage the Fake News.
The staged Fake News media frenzy was Character Assassination of the Founder who is a women's rights advocate of The First Case in The World’s Fashion History.
In 2013, Victorinox’s Attorney Ryota Yamagishi was the President of the Tokyo Bar Association and Vice President of the Japan Bar Association when the Founder counter-reported the Japanese government to the United Nations High Commissioner for Human Rights on the Prada women's discrimination case. The United Nations called on the Japanese government to introduce new regulations outlawing sexual harassment in the workplace, improving working women to speak up for their rights. Japan was the only country that media avoided to publish the UN outcome of the case.
